Terms of Service

These terms cover use of Mugwheel, a free, currently-in-development, local-first creative workspace application. They're written for what Mugwheel actually is right now: a free tool built by an individual developer, not a funded company with an enterprise support contract.

1. Acceptance of these terms

By using Mugwheel, you agree to these terms. If you don't agree, don't use the application.

2. Eligibility

Mugwheel is intended for adults running or supporting a creative or business practice. You must be old enough to form a binding agreement in your jurisdiction, and old enough to meet the minimum age requirements of any third-party service (Google, TikTok, an AI provider) you connect through Mugwheel.

3. License to use Mugwheel

You're granted a personal, non-exclusive, non-transferable, revocable license to use Mugwheel for your own creative and business work. This isn't a license to redistribute Mugwheel itself as a product or service to others.

4. Your content, your responsibility

You own the content you create or import into Mugwheel. You're solely responsible for having the rights to any material you use, for the accuracy of your own business records, and for anything you publish or send through a connected service using Mugwheel's tools.

5. Integrations and external services

Mugwheel can connect to services you authorize — currently Google Drive, Gmail, TikTok, and AI providers you configure. Each of those services has its own terms, which apply in addition to these. Mugwheel is not responsible for the availability, behavior, or policies of any third-party service, including changes those services make that affect Mugwheel's integration with them.

6. AI output limitations

AI-assisted features can produce inaccurate, low-quality, or inappropriate output. AI-generated suggestions, captions, drafts, or analysis are a starting point, not a guarantee of accuracy, originality, or fitness for any particular purpose. Review AI output before relying on it or publishing it.

7. Platform API limitations

Integrations with platforms like TikTok depend on that platform's developer program, API availability, and app review status. Features described as "in development" may not function until the relevant platform approves the integration, and platform-side changes can break or limit functionality without notice from Mugwheel.

8. Backups and data responsibility

Because Mugwheel stores your working data locally in your browser by default, you are responsible for backing it up (using the app's export tools) and for the consequences of clearing your browser's storage, switching devices, or browser data loss. Enabling an optional cloud sync feature does not relieve you of responsibility for your own backups.

9. Acceptable use

Don't use Mugwheel to violate the law, infringe others' rights, distribute malware, attempt to disrupt Mugwheel's infrastructure (including the Cloudflare Worker relay), or violate the terms of any connected third-party service (for example, using the TikTok integration in a way that violates TikTok's own developer or community guidelines).

10. Intellectual property

Mugwheel's own software, design, and branding are not licensed to you beyond what's needed to use the app as intended. You retain all rights to your own content, as described above.

11. Third-party services

Mugwheel is not affiliated with, endorsed by, or an official product of Google, TikTok, or any AI provider it integrates with. Their trademarks belong to them.

12. Changes to the service

Mugwheel is actively developed and may change, add, or remove features, including features described on this website, as development continues.

13. Free-service availability

Mugwheel is currently offered free of charge. Nothing here guarantees it will always remain free, but any change to that would be communicated, not applied retroactively or silently to data you've already stored.

14. No guarantee of uninterrupted service

Mugwheel, including any server-side component like the TikTok relay Worker, is provided without a guarantee of uninterrupted availability. Free-tier infrastructure (including Cloudflare's free plan) may impose usage limits; Mugwheel is designed to fail safely and preserve your local data if a connected service becomes temporarily unavailable.

15. Disclaimers

Mugwheel is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

16. Limitation of liability

To the fullest extent permitted by law, Mugwheel's developer is not liable for indirect, incidental, special, or consequential damages arising from your use of the application, including data loss, lost business, or lost content — which is also why backing up your own data matters. This limitation doesn't apply where it can't lawfully be excluded.

17. Termination

You can stop using Mugwheel and disconnect any connected service at any time. These terms remain in effect for as long as you use the application; sections that by their nature should survive (like intellectual property and limitation of liability) continue to apply after you stop using it.

18. Governing law

User decision pending — a specific governing-law and jurisdiction clause has been left out rather than guessed, since it depends on the operator's actual legal residence/registration, which isn't established in the current project context. This should be decided and added before Mugwheel is submitted for platform production review or publicly released.
